The Legal Landscape of Air Quality Standards
Historically speaking, the United States Environmental Protection Agency (EPA) has afforded California special permissions to implement more rigorous air quality standards for vehicles and industrial operations. This arrangement was established decades ago so that California could maintain high environmental standards despite federal policies that may be less stringent. During his presidency, Donald Trump attempted to revoke these allowances and has indicated intentions to do so again. However, current government positions assert that California’s authority in this matter is firmly entrenched.
According to a recent report by Reuters quoting the Government Accountability Office (GAO), it appears that Congress cannot overturn California’s significant initiative aimed at phasing out sales of gasoline-only vehicles by the year 2035. The GAO affirmed this decision should be classified as an order rather than something adjustable through Congressional review.
Legislative Guarantees for Cleaner Future
Given these developments, one might believe that this conflict has reached its conclusion—hopeful as it may sound! It looks increasingly certain that California will prevail in asserting its regulatory control due to existing legal structures.
It’s worth noting not only does this issue affect California alone; eleven other states have also aligned their regulations with those of California. In addition to establishing a complete zero-emissions vehicle (ZEV) requirement by mid-century (2035), there are additional stipulations compelling new vehicle sales: starting with a mandate for ZEVs comprising at least 35% of total sales by 2026, followed by an increase to 68% by 2030.
