Derek McAllister received a 150-hour community service sentence on February 3rd after pleading guilty at Aberdeen Sheriff Court. He was penalized for improperly managing controlled waste without proper authorization and for incinerating various types of regulated refuse between 2020 and 2022 on his property located in Den Quarry, Potterton.
In addition to the initial charges, McAllister faced further scrutiny after failing to comply with a Statutory Notice issued by SEPA requiring him to remove waste from the site effectively. Consequently, he was subjected to a £3,000 Confiscation Order under the Proceeds of Crime Act (POCA) — legislation designed to repatriate gains made through criminal behavior including environmental violations.
